Section 01
Property and Scope
These Terms apply to direct bookings for Marisol Punta Cana Apartment, located at Cañas del Este, Building C, Apartment 403, Punta Cana 23000, Dominican Republic (the “Property”). “Marisol Punta Cana,” “we,” “us” or the “Host” refers to the operator of the Property. “Guest” means the person making the reservation and every registered occupant.
Rates purchase temporary lodging rights only. They do not create a tenancy, residence or ownership interest. For reservations made through Airbnb, Booking.com, Expedia or another platform, the platform’s confirmed terms also apply and control where required by that reservation.
Section 02
Eligibility and Primary Guest
The primary guest must be at least 18 years old, legally able to enter into a contract and authorized to use the selected payment method. Accurate legal name, contact information and identification may be required before access is provided.
The primary guest is responsible for the conduct, charges and compliance of every occupant and visitor connected with the reservation.
Section 03
Occupancy and Visitors
The maximum occupancy is four registered guests, including adults and children. Appropriate arrangements may include one guest, a couple, two couples, or a couple with up to two children, always subject to the four-person maximum.
Unregistered overnight guests are prohibited. Day visitors require advance written approval and remain subject to condominium capacity and security rules.
Section 04
Reservation, Rates and Payment
A reservation is confirmed only after the required payment is successfully processed and written confirmation is issued. The confirmation will state the dates, occupancy, rate, taxes, charges and any deposit applicable to that booking.
The Guest authorizes the processing of the disclosed reservation charges. Failed, reversed or disputed payments may result in suspension or cancellation, subject to applicable law and platform rules.
Section 05
Check-In and Check-Out
Check-in and check-out times are those shown in the reservation confirmation. Early arrival or late departure is not guaranteed and requires prior written approval. Additional occupancy charges may apply when authorized time is exceeded.
Access instructions are confidential and may be withheld until identification, payment and required guest details are complete.
Section 06
House Rules and Community Conduct
Quiet time begins at 10:30 p.m. Music, television, conversations and other sound must remain at a respectful level.
Parties, commercial events, unlawful activity and disruptive gatherings are prohibited.
Pets are not permitted unless the Host gives specific written approval required by applicable law.
Smoking, vaping, candles, incense and open flames are prohibited inside the apartment.
Guests must comply with security instructions, parking requirements, pool rules and all Cañas del Este condominium regulations.
Furniture, electronics, linens and household items must remain inside the Property and in their original location.
Material or repeated violations may result in removal from the Property or termination of the stay without refund where permitted by law and the booking platform.
Section 07
Inventory, Damage and Extra Cleaning
Interior items are inventoried. The Guest must promptly report existing damage and is responsible for loss, breakage, unauthorized removal, missing keys or access devices, and damage beyond normal wear caused by any occupant or visitor.
Reasonable repair, replacement, locksmith, smoke remediation or extraordinary cleaning costs may be claimed using photographs, inventory records, invoices or other supporting evidence.
Section 08
Damage Charges and Deposits
Where permitted by applicable law, the payment processor and the booking platform, the Guest authorizes documented charges for damage, loss or extraordinary cleaning up to the reasonable actual cost incurred. We will provide notice and supporting information before or promptly after a charge, as the applicable process requires.
Any refundable security deposit is separate from the accommodation payment and will be handled according to the terms disclosed at checkout.
Section 09
Amenities and Common Areas
Use of the pool, parking, elevators and other shared facilities is subject to posted schedules, capacity, maintenance, safety and condominium rules. Children must be supervised by a responsible adult at all times.
Temporary closure or restricted access to a community amenity outside the Host’s control does not automatically entitle the Guest to a refund.
Section 10
Utilities, Internet and Equipment
Guests must use appliances, air conditioning, Wi-Fi and other equipment responsibly and follow provided instructions. Internet speed and uninterrupted utility service cannot be guaranteed because third-party providers and local infrastructure are outside the Host’s control.
Illegal downloads, network abuse, tampering with equipment and unsafe or excessive utility use are prohibited.
Section 11
Host Access and Emergencies
The Host or authorized personnel may enter the Property with reasonable notice for maintenance, inspection, guest-requested assistance or rule enforcement. Immediate access may occur without advance notice when reasonably necessary to address an emergency, protect persons or property, stop active damage or comply with legal requirements.
Section 12
Safety and Personal Property
Guests are responsible for supervising children, securing doors and windows, following safety notices and using the Property and amenities with reasonable care. Valuables should not be left unattended.
To the fullest extent permitted by law, the Host is not responsible for loss, theft or damage to personal belongings unless directly caused by the Host’s proven unlawful conduct. Guests should maintain appropriate travel insurance.
Section 13
Cancellations, Changes and No-Shows
Cancellation eligibility, refund percentages, date changes, no-shows and unused nights are governed by the Cancellation & Refund Policy accepted at booking. A request is effective only when received through the authorized channel. Reservations made through a third-party platform must normally be changed or canceled through that platform.
Unless expressly included in the reservation confirmation, resort day passes, transportation, tours, meals and third-party experiences are separate purchases and are not included in the apartment rate.
Section 14
Events Beyond Reasonable Control
Neither party will be responsible for delay or failure caused by events reasonably beyond its control, including severe weather, natural disaster, government order, public emergency, utility failure, civil disturbance or transportation disruption.
We will act reasonably to communicate and, when legally required or commercially appropriate, offer an available remedy under the accepted refund policy.
Section 15
Property Issues and Guest Duty to Report
The Guest must report a material cleanliness, safety or maintenance issue promptly after discovery and allow a reasonable opportunity to inspect and correct it. Failure to report an issue during the stay may limit available remedies when the delay prevents verification or correction.
For urgent questions or emergencies affecting the Property, contact the Host immediately using the details below.
Section 16
Liability and Mandatory Rights
Nothing in these Terms excludes or limits liability, remedies or consumer rights that cannot lawfully be excluded. Subject to those mandatory rights, any recoverable liability related to a direct reservation will be limited to reasonably foreseeable, documented loss directly connected to the affected booking.
The Host is not responsible for independent services purchased from airlines, tour providers, resorts, transportation companies or other third parties.
Section 17
Privacy and Electronic Communications
Personal information is handled according to the Privacy Policy. The Guest agrees to receive transactional communications concerning payment, identity verification, access, safety, support, changes and the stay by email, telephone, SMS or WhatsApp using the contact details supplied.
Electronic acceptance, records and communications may be used to document the reservation to the extent permitted by applicable law.
Section 18
Governing Law, Disputes and General Provisions
These Terms and direct reservations are governed by the laws of the Dominican Republic. The parties should first attempt in good faith to resolve a concern directly in writing. When unresolved, disputes may be submitted to the competent authorities or courts of the Dominican Republic, subject to any mandatory consumer rights and any dispute procedure required by the booking platform.
If a provision is found invalid or unenforceable, the remaining provisions remain effective. A failure to enforce a provision once is not a permanent waiver. The reservation confirmation, these Terms and the incorporated policies constitute the agreement for the stay. Any amendment must be communicated in writing and cannot reduce rights already attached to a confirmed reservation without lawful basis.
